1. AGREEMENT TO OUR LEGAL TERMS

We are Muhammed Yiğit Özgül, doing business as QuitSmokeMate ("Company," "we," "us," or "our"), a company registered in Turkey at Abdurrahmangazi cad. Ravza sokak, İstanbul, Sancaktepe.

We operate the mobile application QuitSmokeMate (the "App"), as well as any other related products and services (collectively, the "Services"). QuitSmokeMate is an AI-powered mobile application designed to assist individuals in their smoking cessation journey by providing tracking tools, motivational support, and progress analytics.

By accessing the Services, you agree to be bound by these Legal Terms. If you do not agree, you are prohibited from using the Services.

2. INTELLECTUAL PROPERTY RIGHTS

Our Content: We own or license all source code, databases, software, AI algorithms, and designs in the Services.

Your License: We grant you a non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use only.

Restrictions: You may not copy, reproduce, or reverse engineer any part of the Services without express written permission.

3. USER REPRESENTATIONS

By using the Services, you warrant that:

• Registration info is accurate.
• You have the legal capacity to comply with these terms.
• You are at least 18 years old.
• You will not access the Services through automated means (bots, scripts).
• Your use does not violate any applicable law.

4. PURCHASES AND PAYMENT

Methods: We accept Apple Pay, Google Pay, Visa, Mastercard, American Express, and Discover.

Automatic Charges: Sales tax will be added where required. We reserve the right to change prices at any time.

5. SUBSCRIPTIONS & FREE TRIAL

Free Trial: We offer a 3-day free trial. At the end of the trial, your account will be charged unless cancelled.

Automatic Renewal: Subscriptions renew automatically unless cancelled via your App Store/Google Play settings.

Cancellation: You must manage cancellations through your mobile device's store settings. No refunds are provided directly by us; they are subject to store policies.

6. PROHIBITED ACTIVITIES

You agree not to:

• Reverse engineer or decompile the software or AI algorithms.
• Use the Services to generate harmful or illegal content.
• Bypass the AI's safety filters.
• Use scripts or bots to extract data (scraping).
• Sell or transfer your user profile.

7. MEDICAL AND HEALTHCARE DISCLAIMER (CRITICAL)

The Services are provided for informational and motivational purposes only and do not constitute medical advice, diagnosis, or treatment. We are not a healthcare provider or a medical device. You should always consult with a qualified healthcare professional before attempting to quit smoking, especially if you have underlying health conditions. Your use of the Services does not create a doctor-patient relationship.

8. AI-GENERATED CONTENT AND ACCURACY

Some features utilize artificial intelligence (AI). AI-generated responses may occasionally be inaccurate, incomplete, or biased. We do not guarantee the accuracy or reliability of AI outputs. Any reliance on such content is strictly at your own risk.

9. LIMITATIONS OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR LIABILITY TO YOU WILL AT ALL TIMES BE LIMITED TO THE LESSER OF:

• The amount paid by you during the six (6) month period prior to the cause of action.
• $50.00 USD.

10. DISPUTE RESOLUTION

Informal Negotiations: Parties agree to attempt to resolve disputes informally for at least 30 days.

Binding Arbitration: Any unresolved disputes will be settled by arbitration in Istanbul, Turkey.

Language: The proceedings shall be in Turkish.

Governing Law: These terms are governed by the laws of Turkey.
